In South Tyrol, a distinction is made between “free” and “conventional” residential property according to Provincial Law No. 13/1997. In the case of a new building, at least 60% of the apartment must be conventional. In the case of a new building, at least 60% of the apartment must be conventional. These conventional flats may only be occupied by persons who have resided or worked in a municipality in South Tyrol for at least five years and who themselves or their family members are not already owners of a flat or do not have the right of abode in such a flat. In addition, the apartment must be occupied within a legally prescribed period by authorised persons who transfer their main residence to this apartment.

What are “freely available” apartments

In South Tyrol, only the so-called “freely available” apartments are considered as holiday homes or second homes. The purchase of a property in Italy can involve some bureaucratic and fiscal difficulties. Unlike the rest of Italy, which has a registration system governed by the Civil Code, South Tyrol has a land register which guarantees legal certainty and transparency. It enables the unproblematic verification of the background of a property and is based on the principle of registration (i.e. only the registered property is valid).

Additional costs when buying a holiday property in Italy

When buying a new property from a construction company the VAT is 4%, 10% or 22% plus a fixed fee of € 600.00 (registration tax, fixed mortgage tax and fixed land registry tax). The purchase of a pre-owned apartment from a private individual, on the other hand, is VAT-free. The real estate transfer tax is made up of the registration tax (2% or 9% of the cadastral value), mortgage tax (€50,00), and cadastral tax (€50,00).

The process of purchasing a property in South Tyrol

Usually, in South Tyrol, an irrevocable purchase offer or a binding preliminary purchase agreement is drafted first. At the same time, a deposit of 10-30% of the purchase price is usually paid to the seller as confirmation.

The second step involves the certification of the purchase by an Italian notary public by means of a notarial deed of sale, followed by an application for the incorporation of ownership in the land register.
